1. Agreement
By using the ExclusiveKC website, requesting a quote, or booking or receiving transportation services from ExclusiveKC (“Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use our Services.
2. Services
ExclusiveKC provides luxury ground transportation (including sedans, SUVs, and related vehicles) in the Kansas City metropolitan area and as otherwise agreed in writing or confirmed at booking. Service details, vehicle type, pricing, and availability are confirmed when you book or when we send a written confirmation. We reserve the right to refuse service for safety, legal, or operational reasons.
3. Booking and payment
Bookings are subject to availability. Rates, deposits, gratuities, tolls, parking, wait time, and other charges will be disclosed or confirmed before or at the time of service as applicable. You agree to provide accurate contact and trip information. Failure to appear at the agreed pickup time (“no-show”) or late cancellations may result in charges as communicated in your booking confirmation.
4. Cancellations and refunds
Cancellation and refund policies depend on the type of reservation and timing. Unless otherwise stated in your confirmation, you should cancel as early as possible. Deposits or prepaid amounts may be non-refundable or subject to forfeiture if you cancel inside a stated window or fail to show. If you believe a charge is in error, contact us promptly at the contact information below; we will review in good faith.
5. Conduct and safety
Passengers must comply with lawful instructions from drivers and applicable traffic and vehicle rules. ExclusiveKC may terminate or refuse service for unsafe, illegal, or abusive behavior, or for excessive damage to vehicles.
6. Limitation of liability
To the fullest extent permitted by applicable law, ExclusiveKC and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Services or this website. Our total liability for any claim arising out of or relating to the Services or these Terms is limited to the amount you paid ExclusiveKC for the specific trip or booking giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater, except where such limitation is prohibited by law.
We are not responsible for delays or failures caused by weather, traffic, road closures, security events, third-party suppliers, or other circumstances outside our reasonable control.
7. Website disclaimer
The website is provided “as is.” We strive for accuracy but do not warrant that all content is error-free or complete. Links to third-party sites are for convenience only; we are not responsible for their content or practices.
8. Governing law and venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. For any dispute arising out of or relating to these Terms or the Services, you agree that the state and federal courts located in Kansas City, Missouri, or another forum in the Kansas City metropolitan area as required by law, shall have exclusive jurisdiction, and you consent to personal jurisdiction there.
9. Changes
We may modify these Terms at any time. The “Last updated” date will change when we do. Material changes may be communicated through the website or at booking. Continued use of the Services after changes constitutes acceptance of the updated Terms.
